Welcome to LoyalPocket. These Terms and Conditions ("Terms") govern your use of our website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Services. If you are using our Services on behalf of a business, you represent that you have the authority to bind that business to these Terms.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials, notifying us immediately of any unauthorized use, and all activities that occur under your account.

4. Description of Services

LoyalPocket provides a customer loyalty management platform that allows businesses to create and manage loyalty programs, track customer transactions and point balances, create tiered reward systems, access analytics and reporting tools, and manage staff accounts and permissions.

5. Subscription and Payment

We offer Free Trial (10 free sales), Business Plan ($29/month), and Enterprise Plan ($99/month). Subscriptions are billed monthly in advance. Prices are subject to change with 30 days notice. All fees are non-refundable unless otherwise stated. You are responsible for any applicable taxes.

6. Acceptable Use

You agree not to use the Services for any illegal purpose, attempt to gain unauthorized access to our systems, interfere with or disrupt the Services, upload malicious code, collect user information without consent, send spam, or resell the Services without authorization.

7. Intellectual Property

All content, features, and functionality of the Services are owned by LoyalPocket and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Your Data

You retain ownership of all data you upload to the Services. You grant us a license to use your data solely to provide the Services. You are responsible for the accuracy and legality of your data. We will handle your data in accordance with our Privacy Policy.

9. Termination

We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or engage in fraudulent or illegal activity. You may cancel your subscription at any time. Upon cancellation, you will have 30 days to export your data before it is deleted.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOYALPOCKET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bulgaria. Any disputes shall be resolved in the courts of Bulgaria.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Services. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
